Terms and Conditions

1. INTRODUCTION AND DEFINITIONS

Please read the following Terms & Conditions carefully. These terms define and stipulate the rights and obligations pertaining to Anima House (from here on our ‘the Company’) and its Clients, as defined in section 1.1. The Company may amend these Terms, in which case Clients will be notified either directly in writing or indirectly via a posting on the Company’s website.

1.1

The following definitions apply:
‘Company’ refers to C.V. Anima House.

‘Client’ refers to any persons that have accepted these terms and conditions through either registering for a subscription with the company, OR by registering through a third-party platform (i.e., ClassPass or Onefit).

‘Staff’ refers to any persons employed by the company, including its Freelance instructors as well as supporting staff and the Company’s leadership.

‘Studio’ refers to the Company’s physical and operating location in which it conducts its business, namely Kerkstraat 393-H, 1017HX, Amsterdam.

‘Terms’ refers to this Terms and Conditions document.

‘Website’ refers to the domain: www.anima-house.com.

‘Registration Form’ refers to the form that all Clients must fill out while registering and booking at the Company Website.

1.2

The Terms are incorporated into the Registration Form & online booking system.

1.3

The Company reserves the right to alter the Terms in cases in which it deems said alterations necessary
or appropriate for governing the Studio and Clients. Any such changes will be published on the Website
and, until revoked, are binding.

1.4

The Terms shall be governed by the laws of The Netherlands & subject to the exclusive jurisdiction of the
Dutch courts.

2. MEMBERSHIPS

2.1

Subject to condition 2.2, when a person has signed a Registration Form they shall become a Client of the
Company and may subsequently use the facilities offered at the Studio (unless the provisions outlined in
the remaining sections of clause 2 or those in clauses 11 and 14 are violated).

2.2

The Company may accept or reject any person from becoming a Client to the Company.

2.3

The Company reserves the right to withdraw, suspend or refrain from renewing the membership of any Client whose conduct is, in the Company’s opinion, hazardous or detrimental to the physical, emotional, mental, or otherwise, well-being of the Company’s Clients or Staff, or in situations in which the Terms outlined here are breached. Any Clients undergoing such an expulsion shall forfeit all privileges to membership & shall not be entitled to any refund for any period during which his membership is suspended or terminated.

2.4

The Company may offer introductory ‘deals’ at any given point, which are only accessible to persons who are not yet registered with the Company and are therefore not yet considered Clients. Existing Clients are not able to access these deals.

3. OPENING HOURS

3.1

Generally, the Studio is opened in time slots in the following windows:
Mondays-Fridays: 06:45-21:00;
Saturdays: 08:00-13:30; and
Sundays: 08:00-21:00

However, the Company reserves the right to make alterations to these opening hours in special circumstances. Such alterations will be communicated on the Website.

4. PAYMENT & PRICING

4.1

Updated membership and class card pricing is available on the Website. Prices may increase from time to time to reflect increases in cost and benefits. The Company reserves the right to modify such pricing, which will be communicated to and impact Clients according to the conditions specified in section 5.

4.2

Successfully completing a payment for a membership or class card only grants Clients access to the Studio and its accompanying facilities, and no other locations (though access is not guaranteed – see
section 5).

4.3

Subscription fees & payments are non-refundable unless otherwise stated in the Terms.

4.4

Payments and deposits for Workshops, Retreats & other Events offered or hosted at the Studio are also non-refundable. However, in the event of unforeseen circumstances (such as medical or personal emergencies), class credits can be offered to the Client in place of a monetary refund.

5. MEMBERSHIP AUTO-RENEWAL

5.1

The provisions outlined in this clause apply to all Clients that subscribe to the Company through a monthly membership as detailed on the Website.

5.2

Clients shall be notified of any changes in the pricing corresponding to their membership no less than 30 days prior to the date in which the new price would be applied. Clients can subsequently make alterations to their subscription according to the provisions in section 5.3.

5.3

A Client may cancel their subscription at any time through a written request sent to hello@anima-house.com, so long as the request is sent at least 1 day before the date in which the respective subscription is set to renew. The membership will then be terminated before the next billing cycle. Note that this condition does not apply to special offerings (see section 5.8).

 

5.4

The Company reserves the right to cancel a membership and charge administrative fees in the event that a payment is not successfully completed.

 

5.5

Clients may cancel their subscription through written notice to the Company if they either do not wish to accept a change in the Company’s Terms, or do not wish to pay any modified subscription prices, as denoted in section 4.1. The written notice must be sent to the Company a minimum of 15 days after the changes to the Terms or pricing have been communicated with the client. If the notice is received at least 2 days before the next subscription renewable date, then the subscription will be terminated in the current renewal period. If the notice is received within 2 days (inclusive) of the next renewal period, then the Client’s membership will renew at the original rate in which they purchased their membership, and will remain valid for 1 additional period, after which the subscription will terminate.

5.6

The Company will attempt to retrieve a payment from a Client on the day in which their membership is set to renew automatically using a credit or debit card filed in their account. If this payment fails, the Client will be notified, and the Company will attempt to retrieve the payment on two additional occasions, 24 hours and 48 hours after the first attempt. If none of these attempts are successful, then the membership will be frozen and the client will be unable to book further classes until the payment is settled.

5.7

Any monthly membership can be frozen at any time for any duration. To do so, the Client must send an email request to the Studio hello@anima-house.com denoting the exact dates and reason for the membership pause.

5.8

The Studio will occasionally offer seasonal deals and sales on memberships. If a client purchases a membership that is either on sale or with a discount code, then the client is only able to cancel the membership after the 3rd billing cycle is complete (i.e. after 3 payments, including the first discounted month) by following the same procedure outlined in provision 5.3.

6. CLASS CARDS

6.1

The provisions outlined in this clause apply to all Clients that subscribe to the Company specifically through a limited Class Pass, as detailed on the Website.

6.2

The Company’s offered Class Pass have the following expiration periods, effective from the moment of purchase:
Three Class Trial Pack: 10 days
Five Class Pass: 180 Days
Ten Class Pass: 365 days

Unused class credits will expire after the denoted period above, and cannot be extended into a new billing period.

7. PERSONAL BELONGINGS

7.1

Personal belongings can be brought into the Studio premises at the Client’s own risk. The Company does not accept liability for any loss or damage to any such belongings. The Studio has lockers for Clients to make use of to protect such belongings, and Clients are not advised to leave their belongings unattended in the changing or shower area.

8. RESERVATIONS & CANCELLATIONS

8.1

Cancellations made at least 6 hours before a class is scheduled to begin will not result in any penalty to the Client.

8.2

Cancellations within 6 hours of a class start time will result in the Client not receiving their credits back. ClassPass members will incur additional penalties as denoted on their own Terms and Conditions. Furthermore, Clients with an unlimited membership (see clause 5) who make two (2) late cancellations (as defined above) within a 7 day period will be subject to a fine of 10 euros.

8.3

Classes can be booked as much as 14 days in advance through the Company’s online booking system, for which BSport has been hired to facilitate. After a class has reached its student capacity, then additional students are able to sign up for a waitlist (see the provisions outlined in section 10.4).

8.4

The Company’s waitlist operates on a first come, first serve basis. If a Client has enrolled in the waitlist, then as soon as another Client currently enrolled in the class cancels, all waitlisted clients will be notified via e-mail and given the opportunity to enroll in the desired class.

9. STUDIO FACILITIES

9.1

A Client is entitled to use the Studio’s fitness and changing facilities during scheduled class times, including 15 minutes before a class has begun and 15 (training facilities) to 30 minutes (changing/shower space) after a class has ended, according to the class schedule denoted on the Website.

9.2

The Company reserves the right to, at any time, withdraw all or part of its facilities for any period or periods (with notice, if practicable), due to any maintenance work or for reasons beyond the control of the Company.

9.3

Children under the age of 16 may only use the Studio & attend classes if accompanied by and under the care and supervision of an adult. However, the Company reserves the right to refuse service to any minor below the age of 16 if it is deemed unsafe for the minor themselves or for any other Client.

9.4

The Café, which is defined as the approximately 30m2 area upon entering the Studio, is accessible during all opening hours as denoted in section 3.1. The Café is intended for, but not restricted to, Clients.

9.5

Clients with a membership, as defined in section 5.1, are able to acquire products at the Café for a discounted ‘Members’ price. All other persons can purchase goods sold at the Café at the ‘standard’ price.

10. HEALTH, SAFETY, INJURY, & SANITATION

10.1

Clients are encouraged not to engage in strenuous physical activity without first seeking advice from a medical professional in the event that they have concerns over their physical condition and wellbeing. If there are any doubts whatsoever regarding a Client’s health or preparedness to practice at the Studio, the Company urges the Client to seek a professional medical consult.

10.2

The Company reserves the right to refuse access to any Client if, in its absolute discretion, it considers that the health of the individual may be endangered by the use of the Studio’s facilities.

10.3

The Company, Studio, and its Staff are not accountable for any injuries or medical conditions incurred or exacerbated by a Client.

10.4

Clients are required to adhere to the requests and instructions of all Staff members at all times.

10.5

Smoking is strictly prohibited anywhere on or in front of the Studio premises.

10.6

In the event of a fire, all persons inside the Studio premises are requested to calmly and respectfully find the nearest fire exit and make their way outside the Studio.

10.7

After participating in a class at the Studio, Clients are required to sanitize the area of the fitness facilities in which they had practiced, along with all props they used, using the sprays and cloths provided by the Studio.

11. CLOTHING

11.1

Footwear should be removed upon entering the Studio and left in the designated area until the Client is ready to leave the Studio. This does not apply to persons only seeking to make use of the Studio’s Café facilities, as denoted in clause 11.4 and 11.5, and hence only applies to Clients wishing to make use of the fitness and changing facilities.

11.2

Clients can wear any clothing articles that they would like, so long as they sufficiently conceal their groin area and glutes.

12. GENERAL

12.1

Clients must, at all times, respect guidelines outlined in these Terms. Furthermore, Clients must comply with any reasonable requests issued by any Staff on the Studio premises.

12.2

Clients are required to keep their personal details up-to-date in their online profile. As such, all communication by the Company will be sent to the most updated email address indirectly communicated to the Company via the Client’s profile, and is assumed to have been received by the Client. By including their email address in their profile, Clients consent to receiving email communications from the Company.

In doing so, the Client also accepts any risk that email may not be a fully secure & confidential means of communication. The Company will not be liable for any loss or damage suffered as a result of communicating with a Member in this manner.

12.3

The Company reserves the right to refuse admission to the Studio to any persons at any given moment.

12.4

If a Client wishes, the Company can communicate with them via postal service, using the most recently updated physical address on their profile. In doing so, the Client accepts that communication may be delayed any given number of days due to the nature of postal deliveries.

13. LIABILITY

13.1

The Company cannot be held liable or responsible for any service or equipment not being available for any reason.

13.2

The Company reserves the right to make alterations to the types of facilities, services, and products provided, without notice & in its absolute discretion. Furthermore, the Company shall not be liable for any loss or damage occasioned by such alterations.

13.3

Clients bear their own responsibility of ensuring that they are capable of undergoing a routine of exercises provided by any class that they attend. Clients accept the risk of injury from performing exercises & are advised to consult a medical specialist prior to beginning any programme. The Company accepts no liability for loss or damage to property. The Company also does not accept any liability for any injuries sustained by a Client, their guests (if applicable), or any other persons on the Studio premises or outside the Studio.

14. WEBSITE

14.1

Clients accept that information published on the Website may be incomplete or incorrect, despite care being taken to update its contents and strive for factual accuracy. As such, no guarantee is given of the accuracy or completeness of information on the Website.

14.2

The Company reserves the right to alter the information and contents of the Website at any given moment, and will not be held liable from any use of such information. No warranty is given that the Website and its contents or hyperlinks are virus-free or not contaminated. Users of the Website are advised to conduct their own virus checks and to implement their own precautions. The Company rejects all liability for contamination or damage caused by any virus or electronic transmission.

15. PRIVACY & SECURITY

15.1

Personally identifiable information pertaining to all Clients is kept and stored securely. Only authorized employees, agents & contractors (who have agreed to keep information secure & confidential) have access to this information. All emails & newsletters provide opt-out options.

Clients may be contacted via email with requests for feedback.
